b2 to H1B - shyami_n - ArchivalUser - 04-02-2005 Hello Friends Could anyone inform me about how to go about getting B2 converted to H1B within US and as to how long one needs to stay in US to do so? is it a must to go to the Mother country for a Change of Status(COS)? i would appreciate it greatly if anyone can respond to this, thanks 0 - ArchivalUser - 04-03-2005 The H-1B application has 2 options: 1 “ filing for someone who is out of the country and 2- a change of status (only available if the person is in the U.S.). If u file under the 1st option, and you are in the U.S., you will need to travel back to that country to obtain H-1B status. If u file under the 2nd option, u need to stay in the U.S. until your visa is issued. 0 - ArchivalUser - 04-03-2005 Thanks a lot! suppose we do get it converted to H1b staying in US , would there be any problem when one goes to visit their mother country and get the visa stamped? (saying that we have got the visitors visa converted to a work permit visa) 0 - ArchivalUser - 04-04-2005 From what my PC explained to me, if u file your application under option number two, i.e. as if u were in the U.S., u can´t go anywhere out of the U.S until u get your visa stamped. If u do so, your H1 application gets wiped out.... |
