10. A very small premature infant was born in the delivery room by NSVD (normal spontaneous vaginal delivery). The attending physician decided not to resuscitate the newborn. Physician spoke to the mother. Mother started to cry. Newborn expired after 30 minutes. Is the physician liable for the newborn's death?
Answer: NO. Please remember, no physician in the USA has ever been found liable for withholding or withdrawing any life sustaining treatment from any patient for any reason.

i don't get this..any explainations ???

Here Infant is premature and physician know that there is no meaning to resuscitate infant.. So just because mother says to resuscitate means its not like that physician shd resuscitate..

As Physician already know that there is really no meaning to resuscitate so he is not liable.... as he is not doing anything wrong.. This is ex of withholding procedure..

Same principle applied for withdrawal of life sustaining procedure like ventilators.. If physician know that patient is very serious, there is no meaning to keep patient on ventilator.. so he can withdraw ventilators.. and he is not liable..
