well for the patient with HIV positive results i found something in kaplan medical ethics and i will type it for u:
Breaking confidentiiality to prevent harm to others:
other cases in which it is lawfull to break confidentiality include partmer notification for sexually transmitted diseases such as syphilis and HIV.The patient's right to confidentiality in such cases is less important than another person's right to safety.However,all efforts must first be made to enlist the patient to inform the intimate partner.No lawsuit against a physicion for breaking confidentiality in order to notify an innocent third partythat his healthmay be at risk has been seccussful.

now if u know that the patient is practising unsafe sex or sharing needles with others and u adviced him to inform his/her partner/s about the HIV status and he didn't inform them then the doctor (u)is legally protected to reveal his hiv status.When partner notification does occur,it's usually the responsibilty of the department of health.it's the health department that should send the letter to the partners notifying them of the(urgent health issue).
