i am on h4 and my husband is on h1 . we are eligible to apply for ead by oct so i will have to wait till jan to get temp ead.what should i tell the programs abt my visa status if i get interviews before getting ead. pls if anyone is going through the same situation or they have any information pls share it.

123mle.....why do u want to wait till oct to apply for ead.....i would say apply rt away..u never know when the rules change here.......in this way either ead or temp ead would b in ur hands by appl time in sept..and u can definitely write in the caf that u r on ead...

You'll need to transfer your H4 into H1B visa if you plan to start your residency before you're EAD is approved...once you've it...you're all set...don't try for J1 visa as you'll be required to do a waiver!! so if you don't have EAD by the time you expect to start residency then look only for programs that sponsor H1B visas!! best of luck...

I expext to get EAD but I won't have it when I will fill the ERAS Application stuff. What are the prospects if I get it later . Is it going to be of any help. Can I mention about it during the Interview process. Any suggestions will be appreciated

mirt -Hi.....I guess you should go ahead and apply as H4 requesting for a visa on your ERAS application if you don't get EAD by then....never lie in your application process...Once you get your EAD you can personally notify the programs that you've applied by email and update them about your immigration status! If you do get your EAD before the ERAS opens and are almost positive of getting GC before July next year...then you can apply as permanent resident on ERAS...maybe this will help...although you're not giving them correct info (as you only have EAD in your hand)...One thing is very clear...most programs who take FMG's don't differentiate between EAD and GC...both are almost same for them...luckily for us!! As everybody knows if you've GC or EAD you definitely have more chances of matching somewhere

Its known that those with current dates for EB groups will be getting an EAD only by oct/nov .
If oct/nov is the earliest one is expecting an EAD----are you guys mentioning your visa requirement in ERAS application on september 1 st as H4 or EAD(green card)? Can u plz calrify it more ? I am still in lil' confusion abt advantages/disadvantages of applying as H4 vs EAD! would mentioning our status as H4 not make us less favorable/eligible by those programs which will take only those with green card. So, will u be applying to those programs which take only greencards. If u apply as H4 ---then they'll just reject ur application. So, is it not better to mention our visa status as EAD on sep1 , when evryone is saying that we will be getting EAD 's by oct/nov. Thanks !

u have 2 things to fill in eras profile
your current visa status your visa status while doing residency so fill current visa status as H4 and visa expecting while doing residency as ead u can not fill your current visa stats as ead if u r on H4(if u r on H4 while creating your profile) its illegal so never lie in your aplication and more over u can update your profile if u get your ead you can update it |
