1) the person who have the power of attonney or directives will if nobody is there, then it is the responsibility of a physician to discuss with the familly, it doesn't matter neuro-surgeon or a physician in the the trauma team, however the one in the trauma team is the best person.

2) The consent for organ donation is given by the person when she still alive. if the patient didn't say anything about it and they are emergency then the court order is needed.
