we want the same protection for US citizens and Permanent residents to gain residency positions as the British have guaranteed for their citizens and if it means banning all applications from physicians abroad, and thereby residencies, so be it.

we want an end to H 1B visas

we NEED (different than want) a propaganda website (like the one Xavier listed above) that spreads the word about the dangers and inequities of H 1B visas and the fact that they are not needed.

we NEED our website to inform every citizen in this country that their taxes are being used to import people from abroad to take jobs that can be filled by americans and to pay their salaries while americans go without jobs.

Those of you, who are making so much fuss about being left out of the match inspite of being Legal Permanent Residents/Citizens/Green Card Holders and the like. You are making too much noise only and you don't seem to be making any solid move to redress your grievence! Mere words and rhetoric will not help you achieve your goal.

First of all, you need to analyse the situation.
Next, you must study thoroughly, the existing laws/regulations pertaining to the problem and if possible, consult legal experts who specialize in such issues. Ofcourse, this requires allocation of substantial time and money. But above everything else, it doesn't help your cause by being emotional or by asking for views of members of this forum similarly affected as you are.
FIRST: You must understand that residency spots are allotted by the NRMP (and not by the hospital/University) after going through an elaborate matching process. The legality of the whole process had been challenged by some aggrieved physicians like you, in the past. That the case was dismissed and the legality of NRMP established firmly is well known to the legal fraternity. It is next to impossible to tamper with the NRMP as can be seen from the observation of the Congressional supporters:

Calling the Match an "integral part of an educational system that has produced the finest physicians and medical researchers in the world," congressional supporters of the legislation are concerned that a recent antitrust lawsuit filed against the Match "has the potential to undermine this highly efficient, pro-competitive and long-standing process" as well as divert scarce teaching hospital resources from their "crucial missions of patient care, physician training and medical research."

So, you must now ask yourself: Can I challenge the NRMP? Do I have the resources?

Next point: Some of you think that before a visa seeking resident is offered a spot, others who do not require a visa should be considered. What does this mean? Residency interview is an important and integral part of the whole selection process. For the program director, before he extends an interview invitation to an outstanding but visa seeking IMG, he has to extend invitation to ALL the AMGs/green carders/H1b visa holders, irrespective of their merit. Considering the fact that the residency applicants apply to multiple programs, and the sheer volume of applications and the limitations to the number of interview spots available, program director will have no option but to ignore all visa seeking IMGs. Is it in the overall national interest of the US? Will the US lawmakers support any move that helps accomodating a mediocre IMG at the cost of an outstanding, but visa seeking IMG?

There is also some confusion regarding the processing of H1b petitions. The employer has to meet only the following 4 conditions:
1. Wages: Pay non-immigrants at least local prevailing wage or the employerâ„¢s actual wage, whichever is higher, and pay for non-productive time, Offer nonimmigrants benefits on the same basis as US workers.

2. Working Conditions : Provide working conditions for nonimmigrants which will not adversely affect the working conditions of workers similarly employed.

3. Strike, Lockout or Work Stoppage: No strike or lockout in the occupational classification at the place of employment.

4. Notice: Notice to union or to workers at the place of employment. A copy of this form to the nonimmigrant workers. Section F1 of Form ETA 9035. Labor Condition Application for Nonimmigrant Workers filed with US Department of Labor, Employment and Training Administration.

If all these four conditions are met, the petition will be through. The employer need not look for an american worker all over the US. That condition is applicable only while processinga a green card petition and NOT for H1b.

Irrespective of whatever anybody may say, both Republicans and the Democrats want H1b visa to stay, foreign workers to come to US and contribute to national development and global American competitiveness in the 21st Century. If in doubt, please read this:

So, my advice to all those Green carders/permanent residents/citizen IMGs who didn't match:
Kindly put an end to this acrimonious debate and start working on your CVs.

All you have said sounds reasonable.

But I must state that the University Programs protect their students' interest first. In fact some of them are blunt enough to say that they do not accept IMGs and there is nothing you can do about it.

The Community programs is where the IMG~ Citizens and LPRs should channel their energy.The main question is who is directly in charge of these programs.

Once one can answer this question every other thing is easy!
