Let us discuss all H1b related questions here. can somebody first say a few words about the whole process? i am in india now and as far as i know, you send your prematch papers, step-3 result etc to your lawyer in USA, and he basically applies for H1b approval on your behalf to works and pensions department. that takes time but you can go thru the fast track. after that is approved, you take your passport alongwith that approval letter to nearest consulate for stamping. so basically it ois a two step process, USCIS gets involved only at the second stage. is that it????? as i have herd, we don't need a job in any one of the stages, any info will be helpful. thanks

madwoman you are completely right

but i would like to know about job in any one of the stages also

so called fast track is when you pay 1250$ premium processing fee, and after your license is issued, it takes just 15 days from USCIS to approve your H1B application.

USCIS is trying to make trouble this year. They started to refuse H1 visas this year for community programs because they claim that the affiliation with medical schools is not sufficient.

Can I change from B1/2 to H1b while I'm staying in USA??? The website informed me that I nee I-797 form apart from other documents for regular process.

what if the hospital is one of the most reputed ones and affiliated to one of the top 5 universities of US..and what if that program has its own lawyer services for the incoming residents?

@nostringsattached That's my situation Smile And I got an email from the lawyer that my H1 application can be denied. But he is optimistic and he think that this situation will be resolved soon.
